He deems retired people as "generally expensive to maintain" and "not productive," and therefore unworthy of being spared from the COVID-19 pandemic. Somebody else proposed (and implemented) that same sort of death cult idea 85 years ago. Do you want this guy representing your financial and legal interests? There are scads of attorneys to choose from. Any other one would be better than this monster.

Do you want this guy representing your financial and legal interests? There are scads of attorneys to choose from. Any other one would be better than this monster.

Scott McMillan La Mesa, located in east San Diego, 4670 Nebo Drive, La Mesa, CA, recently lost a major lawsuit in federal court where he tried to remove a report stating his involvement in child molestation. The report was filed as an exhibit in San Diego Superior Court Case No. 37-*******344. The Ninth Circuit clearly cited his lawsuit was meritless. When Scott McMillan lost the federal case, he appealed, and also filed the identical lawsuit in state court and is expressly known as claim splitting. Ethics (or customers) is not something I think the McMillan Law Firm La Mesa has.

Tip for consumers: Review lawsuits San Diego attorney Scott McMillan has been involved in. Although La Mesa attorney Scott McMillan declares to be a “leading” San Diego lawyer in his ads, there are no known peer reviewed honors or titles provided to The_McMillan_Law_Firm or Scott McMillan. It looks like though Scott McMillan provided himself with the honor of such a unique title.

This attorney only cares about money, to the point of screwing over clients if he thinks he can make more in doing so.

I have seen the track record of Scott McMillan La Mesa ranging from being called a vexatious litigant to have a losing track record.In another case involving Scott McMillan, La Mesa, McMillan v. Weathersby (9th Cir. 2002) 31 F.App'x 371, 374, complained about his loss, and being called a None of the three main episodes that McMillan offers supports granting a mistrial. McMillan first asserts that defense counsel violated the court's in limine ruling barring reference to McMillan as a "vexatious litigant" by referring to McMillan's other lawsuits in his opening statement. McMillan LOST that case.

Scott McMillan sued the San Diego Sheriff over its Facebook account, filed a request for preliminary injunctive relief but was DENIED as moot. (Karras v. Gore (S.D.Cal. Jan. 5, 2015, No. 14CV2564 BEN (KSC))

Scott McMillan La Mesa, issue concerning his vexatious litigation was brought up by Frys Electronics, Motion for Preliminary Injunction and Stay to Prohibit Conflicting and Vexatious Litigation Based on Changed Facts or Alternatively, Motion for Reconsideration of November 22, 2002 Order Denying Motion for Preliminary Injunction and grant judgment on the pleadings in favor of Fry's (Lytwyn v. Fry's Electronics, Inc. (2005) 126 Cal.App.4th 1455, 1464 [25 Cal.Rptr.3d 791].)

Now I see a leading law firm filed a lawsuit against Scott McMillan for associate Michelle Volk attorney San Diego, filed a federal case against Scott McMillan for fraud, overbilling, and alleges drug use too. Consumer beware about attorneys who not only have a bad track record, but also have drug abuse problems.

Tip for consumers: I would look at McMillan Academy of Law, Scott McMillan is the dean of the La Mesa law school which is operated out of his small old office near train tracks. Law Dragon school review says Scott McMillan 's school has never had a single law student or graduate.

Scott McMillan, McMillan Associates, 4670 Nebo Drive, La Mesa, California, is a two person law firm that also serves as a law school where Scott McMillan is the Dean - yes, seriously - McMillan Academy of Law. I reviewed the state bar website and not a single student exists who has taken or passed the bar exam. To make matters worse, Michelle Volk and Scott McMillan have lost over 60 appeals - but on the firm website claim to be a "leading San Diego law firm"!! I fell for the tough talk, and in the end wish more people spoke up about this attorney who graduated from a law school which is not ABA Accredited, and was behind a car dealership at the time.

Tip for consumers: Review the attorney's credentials. Scott McMillan does it all on his state bar profile. He sued the San Diego Sheriff over Facebook and got $20 for his client. True story! There are also allegations of being the target of a sexual abuse investigation. He also filed a declaration in federal court while suing the police that federal agents abused him, but no action was taken on the allegation.

Scott McMillan, La Mesa, McMillan Law Firm states he only helps good and honest people. By that definition child molesters are good and honest where Scott McMillan attorney helped arrested child molester Kenneth Bourke in Bourke v. Castanda, Court of Appeal, San Diego, where Bourke acknowledged Scott McMillan , La Mesa, McMillan Law Firm, helped write the losing anti-SLAPP brief:

"Plaintiff requests reversal of Anti-Strike Ruling, and denial of Defendants unjustified attorney fee award of $19,500. (It includes inflated training costs for unlicensed new interns, which judge was no discretion to award) and requests order for reimbursement of costs plus attorney fees for legal support assistance from associated supporting legal counsel Attorney Shaun McMillan, Esq., Attorney Scott McMillan, Esq. Attorney Jim McMillan, Esq, $10,000 each, to McMillan Law LLP for legal assistance, counsel and services...."

In another lost case Scott McMillan, La Mesa, 4670 Nebo Drive, La Mesa, filed, the court REJECTED his argument since the Property based on the assertion that the property lacked evidence of title.Accordingly, the district court did not err by striking the McMillans's claim for lack of standing. See Elias. 990 F.2d at 1523. (United States v. Commercial Real Prop. (9th Cir. July 18, 1994, No. 93-56173)

Scott McMillan now an Attorney in La Mesa lost another case, before becoming an attorney, appealed McMillan v. Camacho (9th Cir. Dec. 14, 1994, No. 93-55760). The court found Scott McMillan was whining about being treated unfairly and was filed WITHOUT MERIT since the court did not have subject matter jurisdiction over the case: Believing that he was being unfairly treated by appellee United States Customs Service, appellant customs broker brought an action against appellee the district court properly concluded that McMillan lacked standing to seek a preliminary injunction on their behalf. Ultimately, the court said, McMillan contends the district court erred by concluding that he failed to show the possibility of irreparable harm. We reject the argument. Thus another LOSS!

I encourage each of you to read the court opinions about the Scott McMillan attorney San Diego in an effort to avoid retaining an attorney who proclaims he is a leading attorney and has a serious loss rate when compared to attorneys who are actually ranked by third parties as being SuperLawyers or AV Ranked and simply do not say they are leading.

Tip for consumers: Scott McMillan, attorney, Law Mesa, McMillan Law Firm, operates the McMillan Academy of Law, out of his law office, without a single graduate, and proclaims to be a "leading" attorney but is not ranked by a neutral third party like SuperLawyers, San Diego Daily Transcript, or Martindale-Hubbell.

"This is just silly" judge tells Scott_McMillan_La Mesa , of McMillan_Law_Firm in La Mesa, East of San Diego, during oral argument before the Ninth Circuit in 2017.Despite Scott McMillan, La Mesa, investing hundreds of hours in a case, the judge told him to take the $450 offered by the Government. Of course, Scott McMillan, who is also the dean of of his own law school operated out of his small office, which in ten years has not see a student per LawDragon Law School review, lost the "silly" case. Michelle Volk attorney San Diego handled portions of the "Silly" case too. Possibly the duo of failed attorneys should not take on pro bono cases without thinking of the long terms effects it will have.

Vexatious litigation impact all of us by clogging up courts with meritless lawsuits. Scott McMillan, a La Mesa attorney who graduated from an unaccredited law school located behind a car dealership , appealed being labeled a vexatious litigant and lost. In another case where Scott McMillan lost, he appealed and lost being deemed a vexatious litigant. See McMillan v. I believe that ATF agents took the missing unfinished lower receivers as what they perceive as war booty. As the ATF agents as a group had already internally dehumanized my client and his company, stealing Lycurgans property was no different than vandalizing the premises at National City. Although the agents were sworn to uphold the law, they found neither act particularly morally repugnant, and both in some way gratifying. Although the damaged store cannot be unvandalized, certainly the war booty can and should be returned.

Tip for consumers: Scott McMillan attorney San Diego, La Mesa, has a few letters from clients on his website saying how great he is. If only 3-4 or people can attest to an attorneys performance in over 10 years of practice - that would be a huge red flag to me.
