Still living in the night mare of the car I bought

I am writing this because if my experience can help just one person, I will be happy. I bought a BMW X5 2009 which was advertised as moving. I was happy that I own it but did not know that my night mare had just begun. After I paid for it, it took me over a month to get the title. Since I did not have a car then, I was using a rental. Once I went to pick it up, I discovered it did not have a water pump. For sure the car was moving but how far are you going to go without a water pump. I bout it $6,000 but it was not worth $2,000. The person who evaluated it knew it but decided to go ahead and do that. Since then I have spent about $6,000 more try to fix it but still it has not passed the state inspection. It also was involved in an accident but this was not disclosed. I had to replace the emergency brake system, all four tires and brakes, front wind shield, all four stratus, the sliding moon roof is broken, that I wont touch, a new battery and so many small things here and there. The windshield washer is leaking so have to change that whole system. I took it to BMW and they told me to trash it, but I have put too much money in it so am stuck. This company is a horrible company. They knew what they were doing selling a piece of crap as a car and I am sure there not ashamed or have no hearts otherwise they would not be doing such business. I have spent over $400 in Uber rides while and still no end in site.

It is now over 8 months and still the car has not passed state inspection. Now I still have to fix the transmission and it is going to cost me over $2500. I found out also that I need a new windshield tank.

The representative responded to me. But you notice all those are hiding in law jargon. A really sincere person would not look at that car and price it at $6000, knowing that the cost of putting it back would be more than $6000. Even if I sold it as junk, I would not get back my $6000 that I paid in the first place.

Thank you for your comment Jerry and we are very sorry to hear that you had a negative experience with Auto Auction Mall. Our clients’ satisfaction is always our top priority, this is why we want to address your concerns.

As you know, we provide the public with access to dealer-only (wholesale) car auctions which they would not otherwise be able to attend as they do not have a dealer’s licenses. This is clearly explained before beginning any process with our clients. Furthermore, we inform each and every client that the vehicles listed on our site are coming directly from the Auction Clearing House and that we do not independently inspect any of these vehicles before or after purchase. Therefore, we cannot provide any warranty or guarantee regarding the condition of the vehicle and all cars listed on our site are sold in an “As-is, Where-is” condition.

The above information was communicated to you prior to you request to purchase any vehicle and when you purchased this specific vehicle. Our site clearly states that the cars are sold “as-is, where-is” and your invoice had the same information.

The information regarding the vehicles listed on our site is provided to us by the Auction Clearing Houses and since we list over 100,000 vehicles we do not (and cannot) independently inspect each vehicle. In your specific case, the Auction Clearing House listed the car as “Run & Drive” and we set out on our site the explanation that the Auction Clearing House uses to describe “Run & Drive” vehicles. Effectively, this means that when the car is brought to the Auction Clearing House they turn on the car, put it into gear and move it forward a foot or so. They do not do any further (or more) rigorous testing on the car and, as a result, the Auction Clearing House does not provide any guarantees or warranty that the vehicle will be run and drive. Since Auto Auction Mall is a separate entity and provides its clients the information provided to it by the Auction Clearing House, we also cannot give any guarantees or warranty. The cars sold by the Auction Clearing House are sold for wholesale prices (i. E. below retail) because, in some instances, additional work may be required on the car.

As mentioned, through dealer-only auctions such as the one you bought your car from, the vehicles are sold as-is, where-is and the buyer must decide if they wish to pay a third-party inspector to inspect the vehicle before making the purchase and/or bidding at the auction (this is stated in our FAQ section). Furthermore, in the email authorization that you sent us to execute the Buy Now on this vehicle, it clearly stated that the vehicle was not inspected by us and was being sold as-is, where-is and that we make no representation, warranty or guarantee regarding the car. Having all this information, you authorized us to complete this purchase on your behalf by responding to this email and, unfortunately, we cannot reverse that sale now.

I bought used 2007 Mazda 5 on 5 February 2019 through this vendor and the online advertisement clearly stated that the title is clean. After I received the invoice and paid for the car and the car was delivered I was told that the title is in fact pending and that I will have to wait up to 30 days to get the title. I was told that this is what a letter "P" on the invoice meant. This was never mentioned or explained to me before purchasing the car. In some US states you can not leave the car even on the street without the plates - which is the case of my state New York as well - otherwise the car will be towed and I would incur cost for towing and storage (and obviously I can't get the plates without the title). Had the advertisement clearly stated that the title was pending and it may take up to 30 days to receive it, I would not purchase the car. To this date (19 March 2019) I have not received the title and for fear of further cost when towed I donated the car to Kars4Kids. I consider this false and fraudulent advertising. I contacted the customer service numerous times only to hear promises that I will get the title soon and that it is my fault that I should have known about the "P" on the invoice. Despite the fact that once I got the invoice it meant that I committed to buy the car already and I committed to pay for it before the invoice was issued.

Thank you for your comments as we appreciate your feedback. We are sad to hear that you had a negative experience but unfortunately you knew that the title was pending for this vehicle before you asked us to execute the Buy Now on the car.

As you now Auto Auction Mall provides the public (such as yourself) with access to dealer-only car auctions. This is where dealers purchase their inventory to sell to the general public.

All of the cars listed on our site come from various Auction Clearing Houses located in the US. We do not independently inspect the vehicles and rely on the information provided by the Auction Clearing House about the damage, status and title status of each vehicle.

In your case, we went back to the telephone conversation we had with you on February 5,2019 when you asked us to execute the Buy Now on the vehicle. As you were aware, we recorded the call since the Buy Now authorization was binding. In that recording when the Auction Specialist went over the details of the car before confirming your Buy Now purchase you were clearly told that title on the vehicle was pending. You knew that title for the vehicle was not available at the time the car was purchased and you still authorized us to execute the Buy Now on the car.

In a title pending sale, the Auction Clearing House has 30-45 days to get title to the vehicle from the Seller and then provide that title to us. We continuously followed up with the Auction Clearing House to see if they received the title. We answered all of your calls and made separate calls to the Auction Clearing House to expedite the process as much as possible. Other than this, there is nothing else that we could have done.

We finally received the title for this vehicle on Monday March 18,2019 from the Auction Clearing House and on March 19,2019 we called and told you that we were sending the title (via UPS) to you. The title was sent with UPS on March 19,2019 and we provided you with the tracking number.

At no time did Auto Auction Mall falsely advertise the car. You were aware that the title was pending for this vehicle as the auction specialist informed you on the recorded call when you wanted to purchase this vehicle. We regularly called the auction clearing house to see the status of the title on your vehicle and kept you informed. We could not have done any more than we did.

They are Ripping people, please please please don't buy with them, they bid on insurance cars from copart and IAAI, better u become member of copart and they provide you with broker, which may save your at least a $ 600 to $ 1000 or more depend on price.

Also they will never help you if some thing went wrong, so better to buy from some one eles, peter is having a way high attitude and liers, I have all proof for customers, if you confused please contact me on *******338. I will expose these fake lier company and save your money.
Because I bought A audi q5 run and drive, and actullay it was with a bad engine, peter told me I will help u, u just to authorize audi mechanic and diagnose it, I did spent $ 450 additional, and than he did nothing. He just raise his hands, its really fake company, useless, lier bad customer service and specially they make me loss $ 9162 dollar in a 15 days.

Run and drive vehical came to me as a bad engine vehical not even start or drive for 0.******* mile, I have video recording till the vehicle arrived in my premises.

They make there money but they don't care if some thing happen wrong to u and misrepresented to u

As you know, we provide the general public access to dealer only auctions. This gives you the ability to buy a car from auctions where dealers buy their cars for a price below retail (or what you would have paid if you bought the car from a dealer’s lot instead of the auction).

We always strive to ensure that our clients have the best and most rewarding customer experience when they use our site to purchase their vehicle at below retail price. Our mission is to give the public access to something they never had before and to make their car buying experience as easy and enjoyable as possible. We have sold many cars and our clients are happy and satisfied with the services and vehicles that they received from us. In order to ensure this, all of our staff are trained to explain the dealer-only auction purchase process and the vehicles that are available for auction.

For each vehicle, we put as much information as we are provided by the Auction Clearing House on our site so that our clients have information about the car and are aware of possible issues. For the car you purchased, in the Status section of the vehicle listing where it states whether the car Starts & Moves/Run & Drive, we have a tooltip beside the “Status” of the car (i. E. (i)) which explains exactly what Starts & Moves/Run & Drive means, i. E. that the Auction Clearing House was able able to turn on the car (either with or without a jump) and move the vehicle forward a bit when it entered the auction lot, but, that the auction clearing house does not warrant nor guaranty that it will be in be able to do this when it is sold. We explained this to you and you saw this information on the site before you purchased the car. If the Auction Clearing House had provided this warranty, we would have been happy to pass it on to you, but unfortunately, they do not.

This is not the first car that you purchased from Auto Auction Mall. You had previously purchased another vehicle and were happy with the price (it was well below market average) and the vehicle. You were also happy with the price for this vehicle as it was well below market average price. We clearly explained to you that we cannot guaranty or warrant the condition of the vehicle since we do not have access to the vehicle before it is sold. You knew this and were comfortable with going ahead with the purchase.

Since we do not physically have possession of the car nor inspect the vehicles, it is made clear on our site and in our terms of service that each vehicle is sold “as is, where is” and that we are not responsible for the condition of the car you purchase. We always recommend (both in our FAQs and when we speak with clients) that if they have concerns about the vehicle condition they should hire an independent third-party inspection company to inspect the vehicle and give a report to the client before they buy the car.

Your experience would have been the same whether you bought the car from us or, as you mention, some other registered broker from the Auction Clearing House.

As you know, we have a flat fee of $299 for giving you access to the dealer-only auction and the final sale price of the car does not affect our flat fee. The Auction Clearing House has its own fees and those are based on the final sales price but those are paid to the Auction Clearing House. Accordingly, we are not clear how some other company could have saved you $600 to $1000 on the price of the car.

When you told us you were upset about the condition of the vehicle we did try to help you with your issue. The option that we offered you was to have you ship the car back to the Auction Clearing House and have it run through the auction. We would not take an additional Auto Auction Mall fee for this but you would be responsible for shipping the car back and the Auction Clearing House sales fees (which we do not control). You did not want to consider this option so we suggested that you contact a mechanic and try to get the best price to fix the issues. We did not, at any time, say that we would cover the costs so we are not clear why you thought we would cover these expenses.
