Does it work with latest IOS software? If so will it work if he updates his iPhones software?

For iOS software, you can contact customer support team, they will guide you. Meanwhile, generally, If any user has installed TheOneSpy software and after sometime Mobile Operating system has been updated then User need to install the latest version of TOS in the target device again.
