Has anyone ever tried to return an Item that had the wrong description to the item and get refunded?

I bid on a pair of Swarovski Crystal Penguins. I was unaware that the larger Penguin was supposed to have a "tail" at the back. It's difficult to see with the cutting of the crystal so I only noticed it when I saw another like item and it had the tail. I closely inspected and can see what I thought was a cut in the crystal is really not smooth and is where the tail should be. The item was delivered on May 12. I put in a claim on July 2 and the company is standing on their 30 day return policy even though they listed as good condition and it was not broken in the box, I've spent thousands of dollars at their site and probably would have continued. The customer service individual refused to let me speak to a manager and just kept repeating the same thing. Now for 134 dollars, I am done with ever buying another thing. Not a good way to run a business. If they are going out... it's no wonder.

I fully agree with the 2 above buyers - I also purchased jewelry on their site and the seller totally mislead the buyers - their description of the items I bid on was totally inaccurate iand misleading! After I found out that most of the jewelry pieces were custom pieces I contacted EBTH - yes, I discovered this 30 days after the purchase REGARDLESS ---- EBTH did not seem to be at all upset that their seller mislead the bidders... they did not care or offer to contact the seller, I will never buy anything else again from this site! And I will also contact my credit card to dispute the carges and return the junk that was shipped to me.

I bid on a parcel containing a brooch and a coral bead necklace. When the items arrived, it was obvious the necklace was plastic. EBTH claims that the jewelry is evaluated by a " gemologist". My 10 year old niece could see that the necklace was plastic. When I called demanding a refund, initially they refused. The customer service rep I was dealing with was condescending and not very bright. I put the purchase in dispute with my credit card company ( basically a stop payment). After I put the charge in dispute, they decided to refund. My advice: If you're going to do business with EBTH, USE A CREDIT CARD! Good luck.
