There are plenty of reviews on this site about the scamming techniques of Usenet.nl
I fell into the trap but gave no credit card information with a view to trying the free download for files as i was looking for an art history publication. It DID NOT even work so i thought no more about it and did not go back onto the site. I had received no services. After a month I was bugged by a credit collection agency related to Usenet called *******@tesch-inkasso.de in Germany. Every week or fortnight they threaten me with penalties having escelated the charge 120 fold and threatening court action. My reply is to challenge them to a court appearence and expose the fraud and claim harassment damages.

Firstly, the actual usenet service was awful. The promised benefits of the service are lies. Then there is their contract. When you sign up with them they send a contract and in the fine print this tells you they will charge you on a recurring basis without ending unless you cancel following the exact process they specify.
I signed up with PayPal and so cancelled the payment agreement through that and thought that would be the end of it.
Unfortunately, a year later I received a letter from a debt collection agency seeking payment of the annual fee in 7 days or else.
I don't know whether to pay this or not. I feel helpless as this company is based in San Marino and I suspect are in that country to stay out of reach the citizens in other countries they prey on. Yet they have a local debt collector seeking payment.
Any advice on how to avoid paying this?
I have done some research on the FTC rules on this and believe that usenet.nl is in contravention of the FTC ROSCA Requirements of:
- Clear and Conspicuous disclosure of continuity
- Express informed consent before charge of renewals
- Simple way to cancel
Consent for continuity billing or so called "negative option feature" must be separate from the offer using a checkbox, signature or similar method.
When we signed up for a free offer with usenet.nl I believe the "extension" clause on the membership was not compliant with ROSCA requirements. It wasn't clear and conspicuous and wasn't separate to the offer.
If you have been stung by usenet.nl you can file a complaint with the FTC stating the non-compliance with the ROSCA requirements as outlined above: https://www.ftccomplaintassistant.gov/#&panel1-1
Do not use this service. Even after cancelling during the trial period and removing my payment options, the company claims to have not received the cancellation and is now sending threatening correspondence asking for an outstanding sum to be settled. Sounds like lots of people have had a similar experience. Terms and conditions are deliberately vague but their legal team seems to think that they can fabricate additional hoops you must jump through to prove cancellation.
On top of all this, software is limited and crashed a number of times (obviously why I cancelled on day 1 of my trial).
I have now had a few questions from others in the same predicament, so I thought I would add these as a Q&A section below:
Q:
What should I do in the same situation? Did you pay?
A:
I did not pay and will not unless instructed to do so by court of law that has jurisdiction.
If you used the service for longer than the trial then you really should pay. If you stopped using the service but did not attempt to cancel in a manner defined within their terms and conditions then they could theoretically take you to court and claim that you are in breach of contract. However, they would probably have to do this in San Marino. The San Marino courts have no automatic jurisdiction in the majority of the rest of the world so your local court system would have to address whether or not the verdict is valid. If you have been given the same rights as in your country of residence, the court may rule in their favour - but this is doubtful.
Aditionally, the costs associated with taking individuals to court is high, and the risks of them losing seem to be high, especially with all the evidence of bad practice strewn around the internet from others who are in a similar position or who have been unable to cancel.
I would be happy to help provide my evidence to you should they attempt to take you to court. However, as I say, I very much doubt they will follow through. I think their M. O. is to threaten/scare people into giving them money but I haven't seen a report stating that they have taken anyone to court.
Q: Will a failure to pay affect my credit score?
A: I'm no expert but, as they have not offered you any credit, it is very doubtful that they could affect your credit score in any way. Of course, if you used a credit card and DID pay them, the credit offered to you would have an effect, especially if you did not pay it off or apply to them to have the charges reversed.
If you were to lose a court battle against them, this could theoretically affect your credit score but it is unlikely. Factors like insolvency or bankruptcy are more often the court-based proceedings which could affect you.
If it WERE to affect your credit score, you could apply to the credit ratings agency to have it removed if you provided evidence that it was not relevant or accurate.
EDIT (6th Jan 2017) - I can confirm that after receiving a large number of threatening letters (I originally responded to each via email, then used the same response to each using copy/paste when they ignored me, then started returning the letters to sender unopened) the company has stopped trying to harass me and has not followed any other course of action. This confirms my suspicions that their tactics are just to try and scare people into paying inflated and excessive sums with vague/difficult to follow T&C's and threatening letters.
Already signed up using a card? Phone your card issuer immediately and tell them that you suspect this company will attempt to take a large sum and that they should block it. Email Usenet.nl in the vague hope that they will actually follow through with the cancellation. Ignore any demands for payment.
