Refund Refused. Ebay accept that I never received the item, and apologised for incorrect advice!

I've had my Ebay account for years and have bought thousands of items and sold some. From the very start, it became clear that in disputes, Ebay tended to side with sellers. After all that's where their commission comes from. This situation has progressively got worse. Most recently, Royal Mail Tracking recorded that I had received an item that I had not received. There is a long standing tried and tested process, for the sender, who has the Contract with Royal Mail, to claim compensation for items that go missing. However, Ebay, ignore all of this and put the emphasis on the buyer, that has no Contract with Royal Mail and therefore can ask nothing of them. Ebay have twice demanded that I supply them with a "Certificate of Non Delivery" from Royal Mail. Royal Mail do not and never have issued Certificates of Non Delivery. I have given Ebay a copy of an email from Royal Mail which states this AND makes it clear that it is for the sender (seller) to make a claim for the lost item. Ebay should by now know this. An EBay Agent then claimed to be an 'Expert' on Items Not Delivered and Resolver. - He claimed that everyone has a right to a 'Certificate of Non-Delivery' from any courier, and that I should raise a Resolver Case against Royal Mail to obtain that certificate. - Resolver do not deal with Royal Mail. There is no indication anywhere on the internet that anybody is entitled to a certificate of non delivery! I have notified EBay that their 'expert' is wrong, providing a screen shot stating that Resolver do not deal with Royal Mail. I have also provided EBay with a copy of Royal Mail's webpage and Citizen's Advice webpage, both of which clearly state that in the case of non-delivery, it for the sender (EBay seller) to claim against the courier (Royal Mail). EBay have apologised for the wrong advice given by their 'expert' and have now shut my claim for a refund without reason! Ebay clearly make my refund claiming for a refund, impossible, even lying and giving factually wrong information, when it would be simple for the seller to make a claim against Royal Mail? Probably because they know that sellers will use the cheapest method of delivery available and won't be covered to the value of the items sent. - Not a buyer's problem! I have been buying less and less on Ebay for this very reason and Because Amazon are a delight to deal with if something goes wrong. This is the first time that I have bothered to search for reviews of Ebay. Am I shocked at the score? Not at all. It may be the Sellers that pay Ebay the commission, but without Buyer's, Ebay will have no business. Well done Ebay, you are destroying your own business!

Tip for consumers:

EBay make it impossible to obtain a refund from them if you do not get your item. They demand that you obtain certificates that don't exist and that you obtain help from organisations that don't help in such cases. Even if they accept that you never received the item and apologise for errors during the Refund Claim Process, don't expect to receive your refund. They have a Worldwide average of just above 1 star on another Review Site. Many people complaining of exactly what I have experienced!

EBay isn't completely terrible, but they need some serious improvement

I use eBay quite often for the most part. I switched to them after experiencing Amazon's dodgy search engine and business practises. You really need to beware of what is offered. READ IT CAREFULLY! There are plenty of dodgy sellers that will say one thing in the title, but something totally different in the advert. For example I was looking at a MacBook pro computer from 2014. The title said it was brand new. The description said it was refurbished with "brand new refurbished parts." A clear conflict in terminology to confuse potential buyers. As a rule, just steer clear of anything that is refurbished, unless it in a sealed box from the manufacturer that says it's refurbished.
The real problem with adverts like these is eBay refuses to do anything about them. You report the advert, but it's never removed or changed. This particular advert is still there, unchanged after reporting it weeks ago! Next is the search engine. When I search for something, I am usually very specific about what I want. I include an exact description, model numbers, etc. Do I get what I want? Yes and no, but more often than Amazon. EBay has also adopted the practise of loading your search results with useless rubbish that isn't related to your search. They seem to think it will entice you to buy what ever rubbish they feed you. No... i just close the page and purchase nothing! And finally the area in which you search. Call me stupid, but I thought when you select "UK Only" it means you will only see results from the UK. Nope... You'll get loads of results from the USA and Australia... but not the EU... wonder why. I won't purchase, say a MacBook Pro, from the USA or Australia. You get screwed with Paypal's exchange rate, you get screwed on the shipping and you get screwed on the import tax. Need I say more?
A final note... if you have a problem with a seller, DO NOT CONTACT EBAY! Open a dispute with PayPal instead. Unlike eBay, PayPal is a financial institution and are governed by the same authority governing banks. They are required, by law, to investigate the dispute, just as your bank would investigate. I would say around 90% of the time you'll get a refund from PayPal. If your parcel doesn't arrive, PayPal will require the SELLER to provide tracking information and proof of delivery. EBay requires YOU to prove that you didn't get the parcel... and just how are you supposed to do that?

EDIT: More eBay stupidity... Their search engine is as useless as Amazon! I did a search for a particular SSD that would replace the overpriced SSD in my MacBook Pro. I specifically searched for a 2TB (Terabyte) Sabrent SSD. Notice in the picture, the very first item is a ONE TB SSD! Did I search for a one tb ssd? No, I did not. I searched for a 2 TB SSD.

Tip for consumers:

Be very particular in your search. Be very wary of what eBay shows you in that search. Quite often, they will show you items that are different or incompatible to the item you are searching. Example, I recently searched for a case to fit my iPhone 12 Pro Max... I saw two cases that would fit my phone and hundreds of cases for other iPhones that absolutely would NOT fit. Also take note if the seller will accept returns. Most do not. So if you but the wrong item, you're stuck with it.

American capitalist business acumen + Chinese Big brother service = ebay!

We are a group that races and builds racing quadcopter drones here in Sussex so we buy quite a bit of components online, including from ebay. However, now we advise our members and supporters to avoid ebay if possible, because its typically "buyer beware" territory, don't rely on their guarantee promise as both ebay and it's sellers obviously do not understand nor practice either.

Two main issues;

Issue 1
Bought four quad motors from seller, paid £52, item failed to arrive after delivery dateline, contacted ebay, was advised to try and sort out with seller, so contacted seller who apologised profusely, initially blamed postal service, asked us to wait, we stupidly did for another two weeks and when we chased seller again, advise will send replacement, which we stupidly accepted, thus had to wait another 28 days.

2nd delivery dateline lapsed, contacted seller who again blamed post, however this time we asked for refund, seller failed to reply. We contacted ebay who told us its past 30 days so ebay's buyer guarantee has expired! We argued that ebay advised us to try and sort it out with seller, but ebay will not barged! We lost £52!

Issue 2

Bought FPV unit in July 2016, paid £20.99, and based on previous experience from issue 1 even though we already have a long archive of email ping pong with the seller who again apologised profusely, blame everyone in the delivery chain except themselves and request us to wait patiently again!, we contacted ebay when delivery dateline lapsed on 30th August 2016. Ebay chat advised us to contact them on 31st to request ebay to help. On 31st August, ebay chat says delivery dateline is 31st, so to contact ebay the next day! We logged back onto ebay website and the previous dateline of 30th have been changed to 31st! Fortunately, we always copy paste to update our complains to our log report, so we regurgitated a copy of ebay's own system's notification of 30th August as clearly stated to ebay chat, but that was refused!

Ebay refused to acknowledge their own system's notification!

So we waited until the next day, 1st Sept, contacted ebay again and was told to go to their website's resolution centre to send another request to the seller asking him to refund, even though we already have a long list of email ping pong whereupon we have asked the seller on numerous occasions for the refund and seller have refused and finally ignored to reply. Then ebay advised us to wait another 9 days!

By now, we have already got a file and must have spend several hours chasing up on this one transaction! Because at each ebay process, there are always threats that if we fail to reply and/or take a particular action, our complain will be nullified and the guarantee expires for that transaction!

Bought the item in good faith on 22nd July 2016. It's 2nd September 2016 and ebay has asked us to wait another 9 days even though ebay have a string of email proof in ebay's own messages system of our email correspondence between us and the seller to show that this seller is purposely delaying the entire process.

Obviously we now avoid ebay, banggood and a couple of other dodgy retail sites and advise our members and community to do so, in order to mount a boycott of such malpractices until these online companies take their responsibilities seriously.

In conclussion, ebay's buyer guarantee is purely a gimmick as the guarantee is purposely rendered invalid by ebay's own business practices.

Tip for consumers:

Possible good values IF you get the stuff at all, forget any buyer guarantee and unless you're a civil servant who enjoys red tape, ebay will wrap you up in so much confusing red and blue tape to muffle any complaint you may have!

Ive just had yet another conversation with an Ebay person in Manilla I believe. Who tells me that my issues have nothing more to do with them. As the sellar hasnt responded to me for over a month I assume Ebays policy is to let poor service or? Prosper. Ebay wont tell me whether the sellar claims he hasnt received them although Ebay keep claiming that I havent got the proof of sending that are right in front of me at the moment. If they could tell me whether the guy is saying he hasnt got them then obviously the post office could do something. If they told me that he has them then Id need to take a different course, all I get from Ebay is the suggestion that I havent returned them. Whenever I say to Ebay I do have proof they just ignore me.

On the 8th of August 2015 I purchased an Omega Gold Plated Seamaster watch from top-watch4U. The guy said it needed a new part, so I was prepared to wait but I didnt receive it until December 2015 and it wasnt working so I returned it and made a complaint to Ebay. Ebay say that because over 30 days had passed it has no responsibility for my complaint etc. I wonder whether the sellar TopWatch4U knew that if he sent it sfter 30 days Id have no cover.

Ebay cant find these emails, although I have just copied them from my messages. Ebay seems to suggest to me that I havent sent them, although Ive receipts from the Post Office and the messages above suggests that the sellar has received the first one that I sent back and still had the one that I didnt receive until December.

EBAY INDIA SPOILS EBAY REPUTATION AROUND THE WORLD FOR HARASSING A HANDICAPPED /PARALYZED PERSON BY REJECTING A GENUINE EBAY GUARANTEE CLAIM

INCIDENT-1: Amit Khurana (a consumer) purchased mobile INTEX AQUA PRO 3G FOR Intex Aqua 3G Pro for

COST: Rs. 3,575.00 paid ON 26/08/2015 through mobiwik. (Paisa Pay ID *******0078)

INCIDENT 2: MOBIEL RECEIVED ON 29th August 2015 and same day the eBay guarantee claim was opened as the brand new mobile was found defective and not working properly.

Incident 3: eBay declined the claim saying that product is under warranty from manufacturer (intex) and consumer should follow up directly with manufacturer.

Incident 4: AMIT KHURANA (CONSUEMR) CALLS EBAY AND reports that he is not well and handicapped and paralyzed since last 3 years and cannot follow up with manufacturer and go to service station.

EBay ahs cheated customer named amit khurana in this case by sending him a defective INTEX pro mobile, and also not respecting his refund request despite his request that he is handicapped and is not in a state to follow up with manufacturer.

Under eBay guarantee, eBay should collect back the mobile and refund the money to customer who needs help and is handicapped.

ON HUMAN GROUND AS eBay is not supporting this concern; eBay should be punished and penalized for this action heavily under law from GOVT OF INDIA TO set an example for
- Penalizing eBay for cheating with customer
- Penalizing eBay for harassing handicapped/paralyzed person.
