So met this really great guy named Ryan King thought he was really on our side he asked us to do a pre sale inspection on our 8 year old home we were selling. The inspector David Jolly came did the inspection asked us to replace one window that had a little condensation in it which we did. Then we got a look at a home that we loved wanted to purchase had everything we wanted. He told us there was mold, windows needed replaced some, kind of mold in the internal vac system had mold which I'm allegeric to so that was enough to walk away! The pool needed to be inspected because of age. We backed out of the home because of $50,000 worth of repairs based on his inspection and that the sellers weren't willing to come down evidently. Was that really true I don't now. Wasn't finding any homes that we liked that had everything we were looking for so decided that we were just getting an apartment because we had sold our home through Ryan at Berkshire Hathaway he btw never actually found us a home I was finding the homes I wanted to look at, he never found us a home His wife found one that I had not already asked Ryan to see. I found all the homes I wanted to see just like I found this one that day. I decided not to look anymore and just get an apt until we find the right place for us and then that day I see this house one acre pool and ok to have pole barn. We have a home inspection again with David Jolley. He says there's a couple cracks in the pool doesn't appear to be a leak, everything's fine with the home besides a couple cracks in the tile in the showers that need to be caulked or replaced. No water intrusion. Nothing now two weeks after moving in lights don't work fire alarms don't work which one is open with no battery in it at all and previous owner says it was like that when he moved in. I admit I missed it, but a home inspector should not have. He is trying to look for that. He told us there was marks in the pool that look like it could leak eventually so Ryan asked for us to get a new pool liner problem is is not just the liner but the pool but the inspector didn't even tell us it was leaking and the Pool is leaking from the opposite end of where he inspected and notated damage. Garage door only goes up when it wants to. This house has so many problems and we paid $489,000 for it and they are getting away with being shady people! I would not use Berkshire Hathaway or David Jolley for an inspector. David has several law suits online and yet Ryan still uses him. I called Ryan to ask him why David wouldn't find something so severe as fire alarms not working on an inspection he told me I don't know ask David. Do not use Ryan or David do not let Ryan tell you David is a great man and a great inspector. They are looking for a sale and you are the sale! I don't know how many thousands of dollars this will cost us but we paid way too much for this house to begin with because I was told I didn't need an inspection or an appraisal. I guess I shouldn't have trusted Ryan King at berkshire Hathaway or their inspector David jolly! I will be seeking an attorney and will Never use them again.
Has water damage claim on my home in Feb. 2021. The claim was turned over to a 3rd party company named NARS. An adjuster came out assessed the damage and submitted his findings. I also had several contractors asses the damage repair cost and the difference in the estimates from insurance company compared to contractors was a joke. They attempted to send me a check for 5700. 00 for all repairs. That amount wouldn't even cover the materials let alone the labor. Fast forward it's now July and my house sits in ruin without flooring or walls where the mold has caused us to get ill and had to be removed. To date we have been given 13k for repair cost that exceed 60k from multiple contractors. No help for housing has been offered. No help with food cost that has more than doubled due to no working kitchen. We have had no master shower, no master sinks, no stove no dishwasher, no kitchen sink and 1 working toilet and 1 working shower for a family of 5 since March. No assistance with housing, finding contractor, moving our stuff out. No assistance with food expenses that have cost us all of our savings just to feed our family. Eating out gets expensive. They don't care and don't pay. They have withheld money from me since May that was already approved but never released the funds to me totaling 11k. That's illegal, do they care no. They forced us to find our own housing which where we live is nearly impossible and expensive. They offered 300.00 to move my entire family out but didn't offer us anywhere to go. Has anyone ever found a company that would come out and move out all of our furniture and store it for 300.00? The checks they have sent were lost canceled and then found again and resent to me. And because they don't do anything fast the cancelled check made to me before they even bothered to issue a new one. So I unknowingly deposited the large check which bounced and made my account negative in the thousands causing 900.00 in late fees and over draft charges that has still to date not been given to me. This insurance company has not covered my claim to assist with the cost of my unexpected water damage. They have literally costed me 10s of thousands of dollars since claim was first submitted. Not to mention the emotional stress, absences from work, work productivity decline from the distractions of being forced to handle everything on your own. So yea they will be seeing me in court real soon and I'm not settling. I will expose them for the heartless company they are and will make sure they don't do this to another family again. No one should have to suffer like we have been forced to do. I'll leave you on this customer service review of them. Don't return calls or answer them and they get a lot of vacation time. My adjuster took 2 weeks off in a 3 week period. And during the week he worked he failed to contact me once. Nothing was done and nothing has been done. Can't hire a contractor with funds to fix the damage.
My experience with Property Management Services, for the protection and care of my rental home, was less than desirable.
1. PM never told me tenants vacated the property. I was made aware on my final inspection before lease expired. Yes, the rent was being paid monthly, so I had no reason to be alarmed or suspicious. As I entered the property, it was apparent they had moved. I asked PM directly, "When did the move?" PM response, Yes, they moved! I felt like the wind was sucked out of me!
2. Another person was allowed to use the property as a doggie day care and laundry service.
3. All the 3 bedroom carpets were saturated with dog "pee"! When I said this to PM, her response was, "My carpets were "OLD"! The stench was sickening and she said that she didn't smell anything.
4. Two bedroom doors and framework were busted and had to have one door replaced. It was camouflage with wood putty on the door, which I didn't discover until a few days later. I asked her why she didn't notice it? PM response was, "Well, you inspected it too, and didn't notice it either". I told her it is her job to notice and report all damages!
5. The washer & dryer was left in disgusting, filfty condition, with tons of dog hair left in the dryer vent, and inside the dryer. The washer was coated with dog hair and caked on dirt.
6. The back door & frame, and some house siding, were all scratched and dented by a large dogs paws. PM never mentioned this damage either.
7. After a water pipe backup in the basement, which I had my service cleaned the sewer line, I asked her repeatedly for pictures of what it looked like... was it cleaned up, was any debris on the floor, please send me pictures... she never sent one picture! In addition, the person or people who had unauthorized access to my rental, let multiple dogs run over the entire basement, spreading the mess everywhere!
8. The kitchen appliances were left in filthy condition, glass cabinet doorknobs were missing or broken.
9. They intentionally ran over a soaker hose and some expensive plants in the flowerbeds with an electric lawnmower.
10. The general yard maintenance was also non-existant. I asked PM many times... has the weed trees/bushes been cut down? PM told me "YES", but that was not true.
11. The doorbell on front and back doors were missing.
12. The furnace was not working, and I was not made aware of this. At anytime, during the PM contract.
13. So overwhelming were the numerous repairs, not to mention the cost, I contacted the Corporate Office in Grand Rapids, Michigan for monetary reimbursement for such negligence.
The Manager in GR seemed concerned, but did a 360, and would not answer my calls after numerous emails. Then, directed me back to PM to take care of the issues. I was shocked, disappointed and really felt very upset!
14. At this time, I'm still recovering from the financial damages for repairs and cleanup.
15. Before I saw the condition of my property, I was asked if I was going continue renting - I said "yes".
I only had 6 weeks to repair all the damages, and cover the cost of such repairs.
16. At one point, I was so overwhelmed, I told PM that I can't rent this quickly. Since PM had already found a tenant, I was told, "the new tenant could take me to court", he wants to be in by the beginning of September.
17. As soon as the new tenant occupied the property, PM gave "ALL" the keys to the new tenant. Which means, PM did not have access to manage my property rental in any capacity, for alarm system, maintenance repairs, or emergencies. However, I was still paying for PM services.
Mike Maselli@ Berkshire Hathaway HomeServices PenFed Realty 2503 Wilma Rudolph Blvd Clarskville, TN ******* took over as property manager for our home in Clarksville, TN in August 2018. We have had three years of issues with Mike as our property manager. He is rude, disrespectful, unethical and unprofessional. I had to constantly contact Mike to do his job! Over the years I have requested copies of all the service receipts for work done to my home. He has refused to send me proof of what he was deducting money for. I'm entitled to know what I'm paying for don't I? He has falsely accused me and my neighbors of being racist multiple times when he was called out for not doing what we hired him to do. Luckily I saved ALL emails proving so. Recently Mike verbally assaulted my realtor during a phone discussion when he was caught in one of his many lies. Biggest issue to date is Mike lied to me about the condition my home was left in from the renters. He was bitter we didn't list our home though him, and wanted to quickly get rid of us. Along with the nasty condition my home was left in, Mike denied knowledge of a massive odor left in the home. When I emailed him telling him about the odor and how it was making my realtor sick he responded saying "There are NO horrible smells. It's absolutely ridiculous that someone went inside and felt sick. Probably just the scent of the carpet cleaning solution drying. Your realtor has been licensed for just 5 months and I am convinced your neighbor has an unhealthy bias for Korean people (based on former correspondence). Both with not much experience. PLEASE just put your house on the market. It will sell in 10 minutes even if a stink bomb went off inside!" Clearly getting no help from him we had to hire a professional cleaning and restoration company to get rid of the intense smell. $1,100 later, the company determined the abundant smell was from the renters using a massive amount of mothballs to cover up smoking in the home! They had to clean every air vent and receiver and then had to use an industrial purifying machine for 24 hours to get rid the smell. Smoking in the home was a clear violation of our lease. Mike and his team ignored these and many other violations, which is a breach of contract. They were supposed to be going in my home twice a year and checking on the care of my property. How he can claim he didn't see any violations is a lie! Mike also claimed to of hired a cleaning company to "deep clean" my home after the renters moved out. They didn't do much, if anything at all. All my bathrooms had soap scum build up, dirt and grim. All the counters, windows and blinds had yellow nicotine residue from the smoking. I had to hire a cleaner to get rid of it. But Mike said "he personally checked the home" to make sure it was ready to be handed over to my realtor. Another lie. When I emailed Mike about the issues my home was left in, I asked him to please take the cost out of the renters deposit. He emailed back saying "This will not be a tenant charge, please don't send me an invoice." Mike and Berkshire Hathaway PenFed Realty banked over $6,000 from me for doing nothing! Dealing with all this while living out-of-state due to military-is extremely frustrating! Why did we even hire him? Mike needs to be held accountable so no-one has to go through what we have!

We purchased a beautiful home in August; however, the listing agent Nita Desai (*******) associated with Berkshire Hathaway, made our supposedly exciting home buying experience painful and miserable. I am one of the buyers and I am also the buyers' agent.
Nita Desai is reckless, hostile, incompetent, unprofessional, a bully and a harasser.
Recklessness: She started an argument with our house inspector after she demand to have the inspector to give her a copy of the inspection report and got declined
She is hostile: Nita Desai thinks she is perfect, she has no fault, and all faults are others. When I pointed out an inaccurate statement she made about the Request for Repair, she flipped! She first indicated I hurt her feelings, then blamed her client the seller - then accused me of insulting her! She would bring up the same issue over and over and over again, EVEN we chose not to argue with her by not commenting it her emails, but that didn't stop her, she had those personal attack on me coming and coming. When she accused me of lying and violated DRE rule, I provide WRITTEN proof, that did not stop her from denying it, because she is never wrong!
Incompetence: She brags about her 35 years of experience yet demands our lender to release loan contingency; she sends us defective "notice to perform"; she pushes for loan contingency release before she provided termite report
Unprofessionalism: She disrespects her clients - both the seller and the buyers. She publicly shares the seller's personal information by telling us her client was on a working visa who first got furloughed then got laid off so he had to leave the country and sell the house, a total violation of DRE Codes of Ethics, Article1-9.
She is a bully: When comes to "agent corporation", Nita Desai's style is to bully you, she sets the time-frame, not DRE; she calls the shots; blames the seller; if you don't meet her timeline, she would threat you - she threatened to cancel the contract twice even though we were not late for any deadline but hers. Try to image as the buyers who really love the house, put down a huge deposit, reviewing hundreds of hundreds of disclosures, providing the lender endless documents for loan approval, doing verification, juggling personal life under Covid, the amount of stress it brings when the seller agent threats to cancel your contract?!
In Nita Desai's world, the truth is what she believes it is! If she puts words on her emails, they became truth, and she would go after me and my manager to prove she is right. She is so confrontational. She puts her personal feeling before business, ethics and professionalism. She cannot accept other professional has a different business opinion with her, because she is always right. And, she is so good at pointing finger first, blaming me for her own faults.
She brought so much unnecessary stress, sleepless night to us during the escrow and AFTER! She showed up at our property twice after we closed the escrow, tried to talk to us, and I had to walked away twice to keep myself from letting all the frustration out and lose my cool and professionalism - I tried so hard to put this behind us and move on as her name just brings pain and my blood pressure up to the roof!
On Thursday 10/08, two months after we closed the escrow, she sent a fussy text message requested to stop by at our house! I made sure her request had nothing to do with the house transaction, then declined. I made myself very clear that she needs to refrain from reaching out to us whatsoever, we are not interested in hearing from her. Since that sounds a little harsh, I added:"if you wonder why, you can check her emails," That did not work out at all, Nita Desai quickly fought back and I realized she reached to me two months after we close the escrow just to have another fight, to make me relive the miserable 35 days again. I once again advised her to stop contacting me, I thought that put an end of it - I was wrong!
The next day, Friday night at 8:43PM while I was having a wonderful time with my family, my phone lit, the last person in the world that I'd like to hear from texted me, this time she demanded me "to stop the communication"! This time, I did not hold back and could not hold back anymore, she is harassing me! She still thinks she can call the shots, gets the last words in bully me! After all she put us through, she still believes she is so likeable that when she is ready to social with us, we should just welcome her with open arms? If not, she will start the "she is right, I am wrong" fight again.
Nita Desai is a mean-spirited human that we were very unfortunate and had to deal with and still dealing with. She now escalated her game to harass us and we have no choice but seeking the proper channel to stop her.
I have a number of complaints regarding this businesses practices in customer service and home managing. It has been non stop issues since I moved in almost two years ago. This company does not handle maintenance request properly, if at all. They are certainly not handled in a timely manner, even in the even of an emergency. There has been an ongoing issue with pest that I have made the leaders aware of. Any issues in my home, they send the same" handy man to fix. Which is just some random guy with a pick up truck who can " fix things." These things are never done professional or properly. For example, I had a leak or some issue with my ceiling that result in some of the ceiling to fall down, he repaired it after weeks of me requesting someone take a look at it and he left it " undone" photos will be attached below. The ceiling went from white to yellow. He fixed the leak but did not complete the job, they left debris and dust everywhere and the ceilignis yellow. I asked them if he was coming back to paint or to fix the discoloration of the ceiling and they said " no" the job was closed. I reached out to the guy directly but to no avail. This was almost a year ago. Nex issue, pest... every kind you can imagine, bugs, rats, mice... etc. Etc. I reached out in reference to this issue. A company was sent out. They never entered the residence, i never saw them or spoke to anyone about the issues regarding the rodents once i filed my complaint. I got a call from the office stating someone had been by and placed traps and moth balls outside. The issue was rats iNSIDE of my home. An infestation of rats, We caught a total of three rats and one mice in the timeframe in which we waited on them to come out. Still they never entered the residence. The moth balls help for a moment but eventually they returned. It is now warm out so we are seeing no signed of rodents. This is the only thing that has helped. We set our own traps and poison to mitigate the issue. Again, no one ever entered the home to see the source or how. Why they kept getting in. As a result, my 7 year old was exposed to rat blood. The front office *( ANNA MENNEFEE) was helpful at first, she worked with me when I was late paying my rent some months. As a result of her help in the beginning, i feel as if my complaints or issues were being ignored. She event stated " i helped you, when you paid your rent late as if that was her reasoning for not responding to my request properly. As a. Result of previous late payments, I was unable to access the portal this company uses to take payments. COVID 19 comes around, the governor issues a stay at home order. So of course I make the smart assumption that this company would not require me to drive in a payment. WRONG! I reached out to the company in April to let them know that I could not access the onoine portal to pay the rent and that I would not be able to drive into their office due to " required isolation." I told them that I would need to have access to this portal to pay my rent, i provided them with documentation that showed, i lost access to the portal months ago and that the portal would not accept my payments when i tried. Instead of them fixing this and waiving the fee. They argued with me about if i did or did not have access, despite having proof that i did not and had not had access for a long time. Basically they charged me a late fee for April 2020 because i couldn't drive my payment in or mail it through USPS overnight during COVD 19's peak! I plead my case with them a million times, provided all documentation needed, they lifted the fee and then tried it add it on the backend of this month to my surprise. This company charged me a late fee because their portal was not online when I attempted to make my payment, when i made this clear to them, their response is " pay the fee or we will file an eviction basically. The business is super shady. They help you and then try to stick you later for fees you dont owe. Anna mennefee, is completely unprofessional, she takes everything personal, will hang up on you and not pick up your calls intentionally. She had the nerve to answer my call twice and act like she couldnt hear me. I checked my phone during another call and it was working fine so she intentionally pretended she could not hear.
I had Roger G. From Berkshire Hathaway in Auburn list an apartment building for me. The City of Lewiston gave me a letter of repairs that needed to be fixed. I fixed some of them and decided to sell the property for $40,000 under market value to allow the next owner to fix the repairs. I knew this would be an easy sell even if I listed it on my own, but I am not familiar with the paperwork involved in selling a preprty so I decided to list it through an agent. I got charged 10% premium which is extremely high, but I agreed to it and that is not my complaint. The city of Lewiston gave me the letter and it stated that I had to let the new buyer know all the repairs and had a list of instruction. I gave the letter to Roger the agent, and the agency. The instructions were never followed on certain disclosures that needed to be told to the new buyer. I asked several times if it was all set and I was told "yes, this is why you hired me" After I sold the property I got served with a lawsuit from the city for $25,000 for failing to file a single piece of paper. Fortunately I fought this in court and proved that I have told the new buyer of the problems on my own via text message and email. Unfortunately this still cost me almost $1,000 in a court ordered fine. I reached out to the owner of Berkshire Hathaway in his office in Bangor. He asked me to forward all the documents, and I did. He almost immediately sent me a certified letter stating they would not cover the fine of $1000 which was their mistake, since they are the trained professionals that I paid to make sure all the paperwork was in order. This is why they have a license, to ensure buyers and sellers come together legally on both side. I now have to take Berkshire Hathaway to court which I am in the process of doing. I paid them almost $10,000 in a sellers commission which they did not split with another agency. I chose to under price my property to allow for a quick smooth transaction and had an offer within 2 weeks. This was quick easy money for them, and all they had to do was make sure the paperwork was done correctly. I recommend if you use this agency that you pay a lawyer to go over all the paperwork. This is something you should not have to do when going through a listing agent for a basic real estate transaction with no real hoops to jump through. I strongly do not recommend Berkshire Hathaway for real estate services.
I will NEVER bring another car into David Maus for repairs. I own 3 Toyota's and drive from Kissimmee to Sanford because the service was always fair and attentive. Well, that is no longer the case. I brought my Tundra in because I was having a problem with it. I did not have an appointment so I dropped it off on a Sunday afternoon because it is a very long drive from where I live and it wouldn't drive over 40mph. After explaining what I was experiencing I asked to have an oil change completed while it was there as well as having the seatbelt checked because the light on the dash stays lit. I was assured that I would receive a call the next day. Monday afternoon I received no call so I called to find out the status and didn't receive a call back until Tuesday afternoon. At that time I was told the problem with the truck was actually covered by an extension of the warranty by Toyota. Great news, right? Not so much, the truck wouldn't be ready until the following Tuesday because there were no parts. I was also told the seatbelt light was on because the sensor in the buckle was bad and it was about $250 to replace it. I did not approve that replacement. The truck is 10 years old and I can live with the light. I just needed the oil changed and the warranty work done.
A week goes by, no call. I leave a number of messages and finally get a call that the part still wasn't available so it would most likely be the end of the week when it would be available. Friday comes and again, no call so I leave messages again. Miraculously, I call a call back late that afternoon that the truck is ready to pick up. At this point, I'm out of town until Monday. When I call on Monday to confirm it's ready to go I have to leave a message and get a call late in the day. The truck is ready to pick up and we have changed the oil, done a "safety check", done the warranty work and replaced the seat belt sensor. I informed the service associate Laura that I did not authorize that replacement. After almost 2 weeks I was understandably irritated and didn't say it in my inside voice. I asked for a manager because I wasn't going to pay for a repair I didn't ask for.
When the manager returned my call I was greeted by an individual who informed me that I couldn't threatened to come in and cause a scene. If I was going to cause a scene, I wouldn't have asked for manager to call me back, I would have gone there and caused a scene. After sharing my saga with the manager he basically said you know what? We' ll just put your truck back the way it was, charge you for the oil change and you can just come get it. It's late in the day and frankly my day started very early. Wow! Is all I can say! Apparently nothing else I shared with this manager meant anything because his employee provided me with wonderful service and the fact that I am a loyal customer means absolutely nothing. If I could give them no stars I would. AND I WILL NEVER TAKE ANOTHER ONE OF MY VEHICLES THERE FOR SERVICE AND NEITHER SHOULD YOU!
In fact, I'm not sure I will even buy another Toyota at this point. And if I do, it won't be from David Maus.
Boca Raton Florida -Berkshire Hathaway Realtor Agent /also a Property Investor making mega bucks is too cheap to market for clients in the mail or on Trulia or Zillow so he searches online website portals for Private Home sellers (For Sale By Owner) people to convince them they cant sell their home themselves. He's trying to get listings to meet his yearly quota for his commission agreement of 75%. He attends sellers open house to get an in home meeting with the home seller ( an Un-invited Meeting) He got my listing contract after 2 months of visiting my home 4-5 times making believe he's my friend trying to help me sell my home. He didn't mail flyers to my neighborhood but targeted me as a private seller which is unethical per the Realtors Code of Ethics. He didn't provide a Listing Agreement plan in advance for review like most other companies would do giving you time to read it all but presented a listing contract to be signed right here and now and didn't go over it LINE BY LINE ( Which YOU must Do) He only highlights and tells me the parts he wants me to know so that the financial obligation part is never brought up Just In Case You don't Like that Part and wont sign. I asked over and over... what else should I know and the obligations I signed up for were all left out of the discussion. I trusted him and never thought he would lie or fail to disclose pertinent facts. What a rude awakening this has been. I believe you are safer as a buyer than being a home seller.
BEWARE, of the Snake who says he's on your team and he's working for you! The minute you sign the contract NO MATTER if you understand it or not or if he didn't explain what you are liable for You're Done, Handcuffed, Forced to forfeit the full commission you agreed to, legal fees, office fee, and pay all their attorney fees and the cost of Arbitration EVEN IF YOU HAND WRITE IN THAT YOUR CANCELLATION FEE is $0.- Zero dollars.
My agent was dishonest and unethical and fooled me by saying there's No Cancellation fee when a cancellation binds you for the full length of the contract to the fullest financial extent and stops you from selling your home elsewhere. They can sue you for the full commission and all fees stated in that contract to collect their money regardless of when you cancel. They will own you, your home and the listing contract for the whole length of the contract if you don't sell your home with them. Nice huh? Are you getting the picture? The "No Cancellation Fee" is a used as a play with words to assure you you're safe when you cancel, Not!.
He got my listing by promising me "No cancellation fee" and an "Exclusionary clause" saying I could exclude people who I'd previously cultivated as buyers from paying Berkshire Hathaway Home Services a commission if they purchased my home as long as I provided the list of names- however that list was never included in my listing contract. It was requested after the listing contract was already signed. The list of names was supposed to be part of that agreement in an addendum or in the comments TO PROTECT ME. When the list was provided he says they are not real buyers and I must have a contract accepted from any of them within 14 days of my signed Listing Agreement which was never disclosed earlier. Now he provides a new requirement that If I don't have a contract within 14 days the list of buyers I may have is null and void. BAIT & SWITCH Technique at its best!
This person was supposed to be working in my best interest. I never dreamed he was really a salesman collecting contracts on behalf of his company never caring if they were ethically procured or not just for his brokers to extract monies no matter if you're happy with their service or not when you cancel and try to get your home sold with someone else or by yourself for 6-12 months ( the length of time of the contract). They also refused to cancel my MLS listing online and I had to request it 6 times in writing before they agreed to cancel the MLS page. While the MLS page was up they were collecting calls and inquiries from buyers for that agent even though I said You're Fired 1 day after the MLS listing went online. They kept it going for marketing for themselves for 6 days after I fired them.
YOU ARE HOSED ROYALLY IF YOU DONT HAVE AN ATTORNEY READ YOUR LISTING AGREEMENT BEFORE YOU SIGN and explain all the fine print to you. Please don't trust the agent or be fooled that the agent is working for you- they are collecting contracts and money for their company period! He also got my listing agreement signed and sealed by his office before my previous Listing Agreement with Forsalebyowner was cancelled. That's a big Ethics violation called Client Stealing.
If you are unsure about listing your home Go online in Google and search the listing agents name.
