I am at a loss why this man would deliberately falsify the truth. I did take some action and wrote to Department of Fair Trading - which believed I had a case for action and followed up by requesting a refund on my behalf. The response that they received from this company, mainly the owner is indescribable and abundantly fabricated. See below:

"thank you for your email. I have previously spoken with Silvana and discussed this matter at length with her. I have also spoken to the sales representative and the installer and note the following points

The sales rep recalls discussing at length with Silvana that the product she purchased is a sun only' product and must be retracted in wind and rain
He can recall specific detail in relation to this subject. He does not agree that Silvana discussed with him protection for her furniture against rain

The installer as per company policy also confirmed to Silvana the correct use of the product, including not allowing the product to be extended during wet weather and high winds. I note Silvana also conceded this in her statement, yet still chose to leave the product extended during significant recent weather events. I also note, that despite being left extended in high wind and rain the product fortunately was not damaged.
Attached is a copy of the terms and conditions that form part of the contract we had with Silvana. Item 10 specifically states that all fabric awnings must be retracted in high wind and rain.
I note that the area where the folding arm awning product was installed is very typical of where this type of product would be used. A court yard area without sun protection. The product is defect free and installed correctly.

The product we have supplied is custom made to specifications chosen by Silvana. Ie: size, frame colour and fabric colour. We cannot re-use this product elsewhere, we are therefore not prepared to refund Silvana. I would suggest that she can still make very good use of the product for sun protection, and that if she wishes to keep furniture outside, then only a fixed building structure would be suitable.

We have also noted that Silvana has campaigned against us on social media and product review sites. Although we believe in consumers right to express their opinions and share their experiences, it is not lawful to commence a campaign against a company with the intent to do it harm. We are reviewing whether this has occurred and will take appropriate action.

He then attaches a copy of their terms and conditions
But what is extremely miraculous, is - they are not the terms and conditions that I have in my possession, in fact I have never sighted these "terms and conditions" before. This man is a disgrace and I am now pursuing further legal action. I have been advised to do so by the Department of Fair Trading.

I purchased a shutter from this company and spoke to their representative, Kerry - On the day he visited I explained to him that my only criteria was to protect my furniture from the rain and he told me that an awning could be done and would suffice. Unfortunately this is not the case. The awning was erected and then it rained, it rained consistently and my furniture was saturated because of course the awning does not protect my furniture. I also could not believe it when the rain came into my bedroom because the awning that this company installed hit the awning that I have over my bedroom window and managed to pull it away from the wall so the water drips into my bedroom. I have a remedy for this (close my window). I was devastated and sent the company images of this situation and asked them to uninstall this awning as there must be some sort of warranty and it has only been erected for 2 weeks. I spoke to the rep, Kerry who informed me that when it rains and it is windy you should retract the awning - I find this hilarious because I again repeated to him that the only reason I purchased this awning because I listened to his expert advice whereby he informed me that my furniture would be protected. He understood that I was upset and informed me that he would pass this info. Onto the owner, I believe his name is Justin. Well I had a telephone conversation with this owner and he informed me that I should have closed the awning. I wasn't expecting this response but I must admit that I became angry and frustrated and told him that I believe it hasn't been installed properly and he asked me if I had a reason for stating this and he had seen it in the images that I had sent and he believed it to be properly installed. I then asked him to remove it and he told me that this would not be happening and therefore I informed him that I would be taking further action and he then told me that if I wrote and did anything derogative towards his company he would sue me for defamation. The man is abrupt and rude and I do not like being threatened. I will let you know what happens next.

I purchased a home in Pimpama and one morning I woke up to a small waterfall in my hallway - Originally I thought it was Isabella (my cat) just bringing in the rain from outside (another story but she has a tendency to love when it rains and bring in the debris) anyway I had a hole in my roof - I contacted the builders and I spoke to some wonderful people but I would personally like to mention Rhonda and Adam. Adam was a joy. He personally came out and saw the damage and organised for a roof repairer (Rhonda actually did that part) but Adam organised a plasterer, a painter and was polite and courteous and I have only thank you's to release to these wonderful people.

HI GUYS I'M BACK. I VERY RARELY WRITE AN EXCELLENT REVIEW BUT THIS ONE IS IT - THE BEST! THIS ORGANISATION ARE BRILLIANT - NOT ONLY DO THEY TAKE THE TIME TO LISTEN TO YOU (AND LET ME SAY I AM A PAIN) BUT THEY ARE SO COURTEOUS AND PATIENT AND THEN THEY STRIKE - THEY WOULD HAVE TO BE THE FAIREST AND BESTEST IN THE WORLD - I LIVE ONLINE AND THEREFORE I MAKE A LOT OF PURCHASES AND SOMETIMES THEY DON'T GO TO PLAN AND I DO TRY TO RESOLVE IT MYSELF BUT NOT ALWAYS GOING TO HAPPEN BUT I BUY EVERYTHING THRU PAYPAL AND THEY ARE SO PROTECTIVE OF MY MONEY AND SO FAIR AND REASONABLE I DON; T KNOW HOW TO EXPRESS MY GRATITUDE ANY FURTHER BUT TO SAY TO YOU OUT THERE EVERYBODY DO NOT PURCHASE WITHOUT BECOMING A PAYPAL MEMBER. I decided I needed a new phone as my old phone Iphone 4 was becoming extinct so did some investigation and thought this company "Ozmobiles" would suffice. Had a look at their options and decided to order an ex display Iphone 6 plus (even found a gift voucher for $50.00 online) was told by their office that this gift voucher which actually has a hyperlink to their site is a third party organisation and therefore has no rights to their company and therefore they would not abide by its conditions but thanked me for bringing it to their attention and they would see to it that it was disconnected still on line). Of course this site is only online and this was communicated to me by an online chat. I didn't hear warning bells (I can be stupid sometimes) and decided to order my ex display phone at a cost of $549.00. Well thank god my saviour Paypal came to the rescue. (kids out there if you purchase anything online make sure you go through Paypal - protection is guaranteed 100%).
Anyway back to my true life situation. Phone arrived and guess what it was stuck in a different language - I already have an iphone so know how to turn phone on and off well this phone had a mind of its own and would only speak this language and nothing that I touched would work. Had a friend come over and he also tried as he is also a compatriot of iphones and he also had the same problem. Only contact with this stupid company is online so I contacted a lady online who informed me that I would need to have communication with another person (more specific and specialised to deal with my problem). A gentleman by the name of Chris send me an email chat and I went online and explained to him my problem - the company is in Melbourne. He came up with a first solution that the cable was faulty - I didn't believe this so explained fully my problem - he then came across with the solution that the phone had a "touch disease". The only solution was to have it send back and they would repair or replace it. I accepted this because I must admit I did not understand what the problem was and I agreed to send the phone back with all accessories and I also agreed that I did not want a replacement or this phone fixed I would prefer a full refund and was happy to send the phone back. He was very polite and accepted this. Well do not believe this company. After a few days I received an email to inform me that the phone had arrived and that their technicians had found the fault and the reason it was in a different language was because it was specifically for sight impaired people and the solution was to press the home button three times and this would have solved the problem therefore they would be sending the phone back and did not accept my solution of a full refund. I was flabbergasted and of course put this in writing but he replied again in the negative. You know me guys I believe in being nice but when someone tries to rip me off I go for the kill and explained to him that I knew my rights and especially in Australia and they even had a 30 days replacement policy on their website which I really didn't care about. This person wrote back and said that they don't accept Australian law. Well I am sorry but they have a company in Australia and therefore they have to accept the law. But of course I did not hesitate to inform them that I would go back to paypal and make sure that they refunded all my money. You wouldn't believe it they came back and said they would refund me all my money but would have to adhere to a 15% restock fine. I must admit but this time I was laughing my head off and pursued them through Paypal and guess what they send me an email to say that they had gone to their manager and he had agreed to refund me fully for my dissatisfaction. Do you believe these people. I am so sick and tired of these companies thinking they can tell little people like us what happens to our well earned money. People be rest assured that no-one is above the law and if you don't know your rights -listen to your heart and don't let these crooks get away with this type of bull$#*!. I am proud to be an Australian and I am also proud to fight for what I believe is right. OZZIE OZZIE OZZIE

Well I decided to get a cheap advertised 30 min massage with chiro consult for $50.00 (believe me this is exactly what the sandwich board said besides their offices in Merrimac, Qld). I rang up and asked if the above was correct and the woman at their front desk yes, and I said great as I am desperate when can I come in and she said can you be here by 10.00 am (the time of my telephone call was 9.45 am) As I was in a lot of pain and had a massive headache my exact words were *absolutely*. I arrived and was asked to fill out a questionnaire which I did - really looking forward to my massage and easing of my headache as I had lower back pain and for some reason I had had headaches on and off for an extended period of 2 weeks so I thought this chiropractor might be the winning edge (stupid and remember I had a headache). After completing the form another lady approached me and I mentioned that I find it very strange that this chiropractor of this particular surgery was called a doctor and she immediately told me that a doctor only takes 3 years to qualify whereby a chiropractor takes 8 years. I find this funny but didn't say anything because, remember I had a headache and I must admit I was being selfish and just wanted my massage. I then was approached by a man who guess what, he was the chiropractor Dr Anthony Golle, who had a distinctive smile and was very friendly, and said it was very strange that my past chiropractors had never taken x-rays and that it would be beneficial to have an xray and that they did them inhouse for only $70. Remember I had a headache and thought oh well, if this guy is good what the hell - I then had these xrays and was again approached by the woman who had told me about the doctor and she decided to take my weight and measurement. Well she took my weight and I heard an outrageous figure and she said don't worry it is always out, (ridiculous) and then she took my height and this was 5cm less than what I really am. I should have realised that this place is deceitful and especially when the kind sweet smiling chiro told me that he was now my family chiropractor and that I was part of this family. I only wanted a massage and I was still waiting. He then said that he had viewed my xrays and that I could get an adjustment from him on the day. But of course this was going to cost me an additional $75 (remember I had a headache) I was mentally configuring this all in my head and was thinking only one thing I want my massage. Well of course what you want and what you get is another thing. I was then manipulated by this chiro in the foyer but firstly I had to sit on a chair with a funny looking pillow on it and this was to get my backside ready or whatever - she obviously had rehearsed the jargon she told me in regards to this little round pillow that was vibrating my bum when I sat down. I still really wasn't listening as I had a bloody headache. I then went and laid down on a stretcher and he did two or three manipulations but I swear it took about 3 mins and then he asked me to walk down the foyer like a model (by this time there was noone in the office but the staff) and really I did not feel like walking like a model (I believe at this stage my headache was becoming a migraine) I then said thankyou and that I felt better and was asked to pay them a full amount of $195. I again reiterated about my massage and I wasn't expecting the following explanation "The masseuse had gone home and therefore I would have to have my massage another day". I find this unbelievable but rather funny and I actually paid for a massage and consult in advance. I don't know if this practice does this to innocent naive mature people like me but was I happy NNNOOOOO

I purchased a emerald green dress from this stupid company DHGate - they sent me the dress but the wrong size - thinking it would be very easy to change this I informed them that the dress was lovely but wrong size - the saga begins. I contacted the seller and addressed the problem - they informed me in broken english that the right size was sent to me - I informed them that it was not the right size and explained that it was probably a size 10 and did not fit me in the breast - they asked me to bring it to a dressmaker and get this altered as there was extra material for me to get it enlarged - I brought it to 3 dressmakers in Australia (even find a chinese one) who all informed me that there was no material to enlarge the dress - the dress could not be altered - it would never fit me - I sent pictures to qualify this and they kept writing back that they were not taken properly and would send me instructions - never received them - DHGate head office finally accepted that the dress had to be returned and my money refunded but that I needed to send the dress back and gave me instructions on how to send them the tracking no. So they could refund me. What a joke - I was suppose to get the return address from the seller (Ballyho) what a fabrication - They lie and continuously lie - The seller kept coming up with solutions - $30.00 refund or how about keep the dress and they would make me a new one as long as I paid $40.00 extra for delivery fee but never was I given a return address - I kept writing to Head Office saying I was happy to return the dress but I could not get a return address from the seller - They ignored me pleas and after 5 days gave my money to the seller because I never sent them a tracking no.
- Do you believe this company. The seller did write back and say that they had received the money but were happy to make me a new dress as long as I sent them positive feedback - I couldn't believe this - Why not blackmail the buyer (me!). These people are disgusting and lie through their teeth. The last response was that they sympathises with me (the customer) but their hands were tied and they couldn't do anything.

I have never in all my lifetime met a disgusting bunch of decrepits like this company. I hope alot of people read this review as they need to know that this company is appalling. I have left out a lot of the saga that happened but I feel the gist of it is here.

Please if your thinking of buying from this company DO NOT!

I have had communication from DHGate which have told me that they
Have looked at my case and will be sending me a full refund in 10-15 days.
I will keep you posted.

At this stage I haven't received anything.
They also said that they will keep reins on their seller.
New Update:
On 24 July 2015 they informed me that my order had been cancelled and that I would receive a full refund within 2 business days. The time has passed and no refund - this company is amazing. Let's see what they can do next!

Went into my bank account yesterday and guess what I have received a full refund from DHGate - it is amazing what you can do when you let the world know that you have been treated wrongly.

I take my hat off to DHGate for doing the right thing and also for giving me a $10 credit which I have utilised and bought myself a pair of sunglasses.
