“Cross draw holster”

I ordered a cross draw holster on April 25th 2020, the purchase amount was deducted from my credit card on April 27th 2020. I was told the wait time was 8 to 10 weeks. Now it's September 25th 2020 and no holster! Am I out $87.85 or do I need to take legal action
