I utilized smallclaim.com to prepare paperwork for an out-of-state small claim. It took months for the paperwork to be prepared and it was never forwarded to the court for processing. I was promised a partial credit by Armen; however, it was never issued. Stay far away from this company. They are very pleasant on the phone but their follow up and actual service are non existent.

I made mistake I taught it is samllclaim court in our city it was my first time when I did paper wrk and submitted it find out it is not our small claim court goverment in our town right of way I call them and also notice two different charges in my card, I did explain it is mistake please cancel an do not charge me they promise but they charge me $175 and $135 when I called them they promiss they will send my money back but they did not only send my $40 dollars when I Called them they said it was management decision. Please do not trust them.

I hired them to handle my paperwork for me so I did not have to. They served the wrong person and because of this I am not able to collect the money owed to me. One of their sales reps promised me if this happened he would refund my money. He has been ignoring me and has not returned my 7 phone calls I have made in the last month.

I have since reached out to the owner Mike Simonian who assured me several days ago that he would help me resolve this issue. I scheduled a time to have a call with him and he did not answer my call and has been avoiding me ever since.

My advice to the people reading this is to file the paperwork yourself. Do not rely on this organization to do it for you because they will screw it up.

I paid Smallclaim.com $129 plus a hefty filing fee (total over $300+) and been checking with the courthouse for 9 weeks now and nothing has been filed (my documents were emailed and sent back tos smallclaim.com the same day). They also managed to charge me $45.00 to serve my defendant by certified mail and when speaking with the county court clerk, she indicated that certified mail service is only around $10-$15 (this is extortion and manipulating set governmental fees clerk also took down their information to present to head supervisor).

These guys are a major scam! They do not know the procedure and my case will most likely be dismissed because the statute of limitation on my case has expired! When talking to the court representatives and looking at my credit card charges Smallclaim.com has squeezed every penny. Now I am out over $300, have to take a day off visiting the courthouse, and the judge might kick my case out. The county clerk also indicated that I could have filed my own case the same day, received a trial date, and saved over $180.00; now I might be out over $8,500.0

I have already filed a dispute with my credit card company and been suggested to contact my state bar.

This review contains serious flaws that merit a response from our company.

First, we can find no record of any order in our system involving the particular amounts mentioned in this review. Without a name or an order identification number, we must question whether or not this review is from one of our actual clients.

Assuming that this is a valid order, the facts are completely misconstrued. The fees charged by our company for certified mail serving include the set fee by the court (which is paid to the court by a check from our company) as well as any additional handling fees to cover the labor and postage costs of sending the paperwork to the court for mailing. For instance, let us say that the client is charged $45 for certified mail serving, and the court fee is $15. We pay $15 to the court out of that $45 fee, and the remaining $30 is used to cover the labor costs of our employees' handling of the paperwork and cost of postage to mail the check and any necessary paperwork to the court.

Another fallacy is the claim that the case will be dismissed because the statute of limitations has expired. This is not possible. Once a case is filed with the court, the statute of limitations is tolled. For example, let us assume that a case is filed on February 18, and the statute of limitations expires on February 23. The hearing date is scheduled by the court for April 3. The judge cannot dismiss the case due to the statute of limitations because the case was filed before the statute ran up.

As for the claim of waiting 9 weeks for documents to come back, we always send out approved documents promptly for filing. Once the documents leave our office, though, we have no control over the process. We have no authority to force the court to move faster, and they return the filed paperwork to us whenever they return it to us. Sometimes, unfortunately, the courts have not responded to us in a timely manner, resulting in delays in moving the case forward. When this happens, we do everything within our power to try and move the process along. However, as previously stated, we do not have the authority to compel the court to do anything.

The reviewer also claims to have filed a dispute with their credit card company, but to date, we have received no notification from the credit card company of any chargeback being filed. This, once again, raises questions about whether or not the reviewer is an actual client, barring any sort of identification we can verify.

The reviewer also complains about how the clerk allegedly told him/her that they could have saved $180 by filing the case themselves. If the client did not do their research properly and ended up paying our company more for the same service, that is not our fault. This is a classic example of the principle of caveat emptor---"let the buyer beware".

Regardless of whether or not the reviewer is an actual client, the review contains serious errors of fact that are presented in a manner designed to harm our company. As such, we consider this review to be defamatory and take great umbrage at it. I decided not to go with this service after it seemed like to much work to work with s company over there phone... Anyway after 3 phone calls promising my money back, I just got off the phone and now they are saying I only get half my money back. Stay away from this company! They even say on their message machine they are not lawyers. Losers!
