Failed to provide appraisal

I was denied by an appraisal in this land deal by deception or lapse of duty.
Jake Fair of ReMax Gardnerville Nv. And Frank Lococo of Northstar Lending Group failed to do an appraisal and did not inform me, in favor of predatory loan.
I recently called carsonvalleyland.com and spoke with Jake Fair.
On or around Octeber 24 2022>
My Mother just walked off a stroke and it got me thinking,
If I wanted to stay in the neighborhood with my support and friends close I should buy a lot to build on.
Being the people person I am, I am sure I shared this and my disability with Jake.
Jake would not present my offer for $15,000 down and owner finance@ 10 % over 3 years at full price.
He said the owners would not even consider it.
The property is unbuildable right now due to septic issues at the complex.
As of this fact no bank would loan on it, I obtained a prequal from USBank.
I then contacted Jake who informed me a conventional loan would not fly.
I think I sweetened my owner finance offer to a 2 year payoff, he still refused to present the offer
He referred me to a lender Frank Lococo at Northstar Lending, Frank arranged a loan.
We then made an offer and signed a contract to purchase bare land at Garnerville Nv.'for $35,000.
The purchase offer I made had an appraisal contingency, as well as the loan required one.
These were accepted by the seller.
The loan Frank discussed with me was $21,000@ %10 due in 2 years with a late fee no more than %10 of the payment.
Payment to be $969.04 per mo.
Buried in the legalese were multiple fees.
The loan disclosures required an appraisal, a loan application and a credit report
The lenders signed off without an appraisal, I was not informed of this change.
The realtor nor loan agent never ordered an appraisal.
I was never informed of this lapse/ change in the contract.
They simply sent over forms for me to sign off.
These had been presented as all items checked and filled.
I proceeded in good faith under the impression that the appraisal had been done and met the lenders approval.
My est. Cost to close fee worksheet even had a hand line item cost of $700 for the appraisal delivered 11/21/22.
By removing the appraisal from the process. I have been wronged.
Had the property not appraised for $35,000, I would have had the right to walk away or renegotiate.
The total cost of the loan was never verbally discussed, the agreement only appeared at signoff.
Many fees appeared, large and small. A fee for extra payments is really a prepayment penalty.
The signing was a typical sign this, sign that. No time to read, and by that time I was pretty much legally committed to the deal.
I have a head injury that makes reading a bit difficult.
However much of these transactions rely on good faith.
Who, even without a disability can digest all the fine print and legalese in a software license agreement?
Crafty and devious persons have buried language in these forms that constitute unenforceable clauses.
Most recently a UK gaming company hid language in one that gave rights to the souls of the signers.
I saw in the disclosures the items discussed, however the fees not discussed evaded me,
I believe the appraisal was not done due to the fact that the last 2 sales of lots in this neighborhood were at $25,000 on 11/14 22.
If it was appraised the loan/ deal would have fallen apart.

Stealing $ from great tenants

I have rented a house through Remax for one year. Prior to moving in, the house was not cleaned even though the lease requires the tenant to have it professionally cleaned after move out. They will say that it was clean to their standards but if I happened to leave the house as clean as it was when I moved in, it wouldn't be up to their standards. So I followed the lease and hired a professional to clean it for move out anyway. There was a whole list of things that needed to be replaced as far as broken screens, missing light bulbs, broken light bulbs, clogged sink, yard full of weeds, leaking fridge, broken blinds and a ice maker that did not work. I was expecting to have someone do a walk through with me prior to moving in but that wasn't the case. I had to move into a dirty house and compile a list of work orders for things to get fixed. Yes, the long list of work orders were done/fixed but it should have already been done. The owners did not want to fix their ice maker on their fridge so I had to pay out of pocket for the new part and labor to fix their appliance. Later in the year during monsoon season the bush in front of the house which is as tall as the roof line needed to be trimmed. The owners refused to take care of it and said it was tenant responsibility. Yes, the landscaping is tenant responsibility but it states the homeowners will be responsible for trees higher than roofline. Looks like a loop hole to me since it's a bush and not a tree. So I bought some hedge trimmers to trim it however I did not own a ladder to reach the top of it. I had to pay 80$ to get it done professionally. Not even a month later the homeowners hired a company to chop the bush in half after I just paid 80$ to get it trimmed. At this point I knew I wasn't going renew my lease. At the end of my lease and it was move out time, I was packing up uniforms that I kept in a spare bedroom closet and noticed there was a white powder on them. I looked up and there was a crack in the ceiling of the closet that I have never noticed before. Which is understandable because it's in a spare bedroom closet ceiling. I never had a reason to go stick my head in the closet and look up. Anyway, I wanted to be present during the move-out inspection and the property manager thanked me for how well I had taken care of the property. The property was in a lot better condition than what it was when I moved in, and cleaner. I pointed out the crack in the ceiling to the property manager just so that he was aware that this was something that I came across during my move out and he 100% knew/believed that I was telling the truth and that I did not cause that damage. It looked like someone was in the crawl space and put a knee or foot on the ceiling. First off, I never had a reason to be in the crawl space nor would I want to go up there. Nor did I have the means to even get up there! If there was an issue, I would have simply put in a work order. Also, if let's say hypothetically I felt the need to go in the crawl space and I cracked the ceiling, I would have had it fixed myself without anyone even knowing. It makes no sense that I'd point it out if it was something I did. In result, I am being robbed of 458$ out of my security deposit for "tenant damages" referring to the crack in the ceiling. It is absurd to steal this money from me. Even the property manager knows and believes I did not do this and STILL they are taking this money from me. If I did not point it out to the property manager I 100% believe it would have been missed. I was also made aware that these homeowners had opted out of getting a home inspection prior to buying the property. They bought the property and then put it up for rent. I was the first tenant. This is more proof that this was there before I moved in. Rent was always on time, never late, even with COVID. This is stealing without a question and something needs to be done about it. People need to be aware about what this company does. This needs to be made right. Either Remax or the homeowners NEED TO MAKE THIS RIGHT.

Tip for consumers:

Do not rent from Re/Max, the will take money from your security deposit of damage that was there before you moved in.

BEWARE. Do Not Use This Awful Awful Company
I owned a home for 9 years and sold it and decided to rent while I found a new place. My experience has been so utterly terrible I couldn't make it two years. I have to bullet this list because it's that long. I'll break it down by category.
Lessee:
In the two years I lived in this property there were $800, yearly, worth of maintenance costs for a freshly renovated unit.
They also own a maintenance/contractor company so it behooves them to continuously break/fix something to increase their cost and fee.
Example, after 7 MONTHS WITHOUT HOT WATER they replaced the element in the hot water tank. A year later it is already broke again.
The lease that I signed was illegal so make sure you are ok with a company that will take illegal steps and potentially harm your property. I contacted the county assessor and indeed it is illegal and fraudulent to rent this space out. It was on me to hire a lawyer and fight it on behalf of the state.
Plan on having angry tenants that break leases early, damage your property (as was the case with the tenant before me because he was so angry with his treatment), or any number or problems.
They are not checking or proactive about your investment. When they came to do the "check up" of the unit and check the filters in the furnace, they said everything was ok. There were no filters in the furnace so they didn't even check.
I will not have to take this company to court over my deposit. Be prepared to be drug into any situation this company gets you into. You may end up in the news someday.
Maintenance issues: Water heater broke, now twice. Sewage backup twice. Leaking toilet wax seal. Broken furnace fan. Broken water pipe before I arrived.

Lessor:
#1. DO NOT RENT FROM THESE PEOPLE
At the showing, Phoebe called me at the meeting time to tell me she would be 30 minutes late for the appointment.
When signing the lease she couldn't stop surfing her phone to answer my questions.
The garage was filled with mold on the walls from a burst pipe months before. I still had to sign the mold release and live with it if I wanted to live there. I ended up painting the garage since they would not do anything about it.
The electrical and utilities to the unit were not hooked up when I got there for the unit so I had to coordinate with the companies to try and get utilities even though everything was in the landlords name. Of course they're not going to let me sign someone else up for a bill/utility. This took weeks to iron out. They eventually had to work something out because the space with not sub-metered because it was illegal to do so. I then had to negotiate a utilities bill.
Sewage smell for 1.25 years in my unit. Coming from an upstairs toilet leaking that they refused to fix. I had to remove everything from the storage room and tape the door/frame so no air could leak out. This began 4 weeks after I moved in.
Raw sewage backed up and in the garage. My entire garage was filled with raw sewage… feces, urine, and paper. It sat for 3 days. Not only did they not fix it or clean it, they did not even reply to any of my multiple messages complaining about the issue.
2 weeks later the kitchen sinks backed up with sewage. 6 DAYS LATER they brought a plumber out to fix it and had the contractor threaten me that if I wasn't there when they arrived I would be charged for the repair. 6 days without water in a kitchen. Atrocious smell in the living room and kitchen even though the sink was covered and taped.
NO HOT WATER FOR 7 MONTHS. I'm not sure what kind of company or human beings make another human being live without hot water for 7 months but it is this trashy company.
The heat stopped working. This is a rare occurrence of an item that got fixed but it was still 2 days without heat.
I was told after signing the lease that I could not have mail or packages delivered to the house.
Their online system is utterly useless along with the personnel they employ. No maintenance request was ever responded to or checked. The only way to get through to them was to email as many people as possible until someone got frustrated and replied.
No site work or landscape done to the property. Grass, snow, everything. It was just left for ruin.
Both living room windows did not have screens so you had to be ok with bugs if you wanted fresh air. The windows actively leaked during rain storms. This was documented in their maintenance portal but they did nothing, obviously. Now the drywall is wet in the cavity and more than likely has mold growing in it.
The space you are living in may be illegal to rent so know that you may be kicked out at any time without recourse.
Rampant mouse problem that I inherited when I moved in. It was on me to take care of the issue even though it was preexisting. I pulled 4 mice a month out of that place while I lived there. You could hear them running in the floor at night and in the morning.
I was charged a fee for "gas" with no backup. 3 days later they charged a late fee contradictory to what the lease states. Their excuse was, "the system automatically generates those fee's". Obviously no one fixes it and it keeps assessing fee's, let alone it isn't coordinated with their leases. I would have to get a check in the mail the day I'm notified or hand deliver it to meet a 3 day requirement. After eventually getting the backup paperwork, I sent a check a day after I sent a rent check. Surprisingly, the check never made it so I needed to cancel it and send another check. Lo and behold, the "lost" check "showed up" and they used the second one against "maintenance" fee's they charged, undocumented, to my account after moving out.
I will now have to go to court with this company to try and get my security deposit back. They are trying to charge me for cleaning and maintenance that is undocumented if that wasn't a surprise from what you've already read. They have not responded to multiple messages already.
These people are the lowliest scummiest human beings I have ever dealt with. I would make absolute sure you do your research before using their services. I was personally in the room when they bad talked a potential lessee and said they did not want them to live there, as the reviews below say.
I can offer documentation on everything I've discussed, which will obviously be useful in court.
