I wanted to update this site on the outcome of my dispute with Hoverboard360 as it was FINALLY resolved when my credit card company said they couldn't help me. I filed claims in both states, CA and NY (CA is where I live and NY is where Hoverboard is headquartered). In addition, I was ready to throw down with my credit card company and wrote the following email which resulted in Hoverboard issuing the RMA and return shipping instructions. A refund was given. My final piece of advice: DON'T GIVE UP!
"Dear Sirs/Madam,
I have been a customer of yours for 8 years. Until recently, I have been pleased with your services. Unfortunately, your recent denial regarding my dispute with Hoverboard360 over their violation of their terms of sale puts a cloud on my view of your company.
Briefly, I purchased 2 Hoverboard360s online on November 20th, paying with my Citibank Visa. As part of Hoverboard360s terms of sale, Hoverboard360 offers a 30 day return policy. Hoverboard360 boards need to be returned in their original packaging and must be in original condition... If you wish to return your board, email us at *******@Hoverboard360.com or call us at *******298 for instructions. I contacted Hoverboard360 within 3 days to return the boards. I complied with Hoverboard360s directions, however, they kept asking for more information (which I supplied), but NEVER responded with an RMA, nor did they tell me where or how to ship the boards. I therefore opened my dispute with Citibank.
Citibank has for more leverage than do I (as an individual consumer) to get Hoverboard360 to comply with their Terms of Sale (as well as the Uniform Commercial Code). It is clear to me that Hoverboard360 advertised a return policy, then reneged on that and slow rolled me, the customer, past their return date. That seems a lot closer to fraud than it does sound business. I turned to you, as my banker and card issuer, to dispute this charge... unfortunately, to date in this process, you have denied my claim, thereby empowering a fraudulent seller by agreeing to their endless cycle of requesting information (which I supply), but NEVER issuing an RMA and return instructions. I strongly suspect that if you deny the charge, the company will have a greater incentive to allow returns as per its policy.
I ask you to reconsider your position, and request the courtesy of a telephone call."
Original Review from Jan. 2016
I am now filing a complaint with the Federal Trade Commission. I want to return the merchandise and despite numerous requests, they have not issued the RMA numbers. My credit card company says there is nothing they can do to help, since they can't force the vendor to issue a refund!
I placed an order a Wednesday and received it the following Wednesday, not the 2 day shipping that I thought and I haven't actually opened the box. Then when I checked on black friday weekend (sunday night) they had there black friday special and it was price 150 dollars cheaper. I attempted via email to contact them to see if I could get a price adjustment. They didn't respond right away so I ordered another one to make sure i didn't miss out on the deal because there website said they could be contacted M-F 9-5. So I tried continuiosly all day Monday to see if I could get a hold of them and cancel the one order and get a price adjustment before anything shipped out. They never answered. So I emailed again. Took till Tuesday for them to respond back to my second email saying that unfortuantely both boxes had been shipped already and they could waive the 15% restocking fee, fill out a form, send them photos of the unopened box, but it was up to me to me to return it to them. I wrote back again and STILL 3 days later havent heard back from them with repeated trying to call and trying to connect to all the numbers. I put in the email that I checked the website before I rebought another one that under their return policy it says 30 days and no mention of a restocking fee and that I apprecaited they waived it, it was pretty sneaky not to list that under the return policy, but if you search the site,( it is under the terms and conditions of the sale), since I could not get a hold of them before the supposedly shipped the second item (to which i never received an confirmation of shipment) I think they should be responsible for sending it back. In addition, I gave them my phone numbers to contact me, still nothing. I have been trying to get a hold of them since Sunday (it is now Thursday) with no luck. THey did however send me a shipping confirmation two days ago, yet if you track it, it only say a label has been created (I would like to point out this is 2 days after they said it was shipped). I still have not received the second item but they did charge my card. I also suggested they get back to me, perhaps I could refuse the shipment and get a price adjustment, but no answer. I did receive a response to my first email two days later, saying they don't do price adjustments and basically with the 15% restocking and shipping I would lose out. Well I responded back saying I had received an email already, but I had more questions please read my other emails and nothing. In totally I have spend countless hours trying to get a hold of them and 6 emails and nothing. I have now attempted to start the return process with the waived restocking fee and suck up the shipping costs since they wont answer. Pretty sure they are ignoring my emails to say now I am past the 30 days price back guarantee. My next step is I am contacting my credit card company. Said on my tracking information over the weekend it was due the end of the day today (12/7/15) but now it "Pkg shipped; delivery being scheduled" ( not the 2day shipping clearly and I would still Ike to point out they told me this was shipped a week ago and I could cancel the order) its stilling Hong Kong! And no response to my four emails since last Monday and Tuesday and Thursday's (request for return address information to ship my first item back befor the 30days runs out) I will be attempting to get a hold of them again today.
