Civil rights on trial in the U.S. Supreme Court

Carol M. Swain is an author, a retired professor of political science and law at Vanderbilt University, and television analyst. Mike Towle is an author, and former newspaper reporter and editor. Their work, "The Adversity of Diversity", mostly written before the Supreme Court's June 2023 ruling eliminating affirmative action requirements in college admissions, "Students for Fair Admission v. President and Fellows of Harvard College", makes the case that other programs or practices such as DEI (Diversity, Equity and Inclusion), CRT (Critical Race Theory), and CEI (Corporate Equity Index) are likely on the way out as well. While affirmative actions were originally envisioned as a means of redressing discriminatory injustices, their applications had evolved to cause reverse discrimination, essentially resulting in the same sort of wrongs they were designed to end.

The "Adversity of Diversity" shows examples of how programs such as DEI infringe on constitutionally protected rights, particularly of white conservative men. Conflicts with Title VI of the Civil Rights Act of 1964 (prohibition of discrimination based on race, color, or national origin in any program receiving federal financial assistance) and the 14th Amendment (the Equal Protection Clause guaranteeing all individuals the right to protection under law) were influential in the Supreme Court's decision in removing affirmative action requirements.

Dr. Swain holds the position that Marxism is a driving influence in today's DEI. It is concerned with group identities, affinity groups, and group discrimination rather than group success stemming from individual merit. It channels suspicion, promotes intolerance, and focuses on conflict, and as such, seems designed to break and destroy rather than to heal and bring unity. The social process of ending racial discrimination had been usurped by the political enemies of capitalism, leading to division and tribalism. She believes that proper diversity requires not division, but assimilation. DEI programs do nothing to accomplish any goals important to business, such as adherence to mission, respect for creativity and growth, building morale, and expectation of profit.

Dr. Swain has developed her own program that she believes may solve the problems created by DEI, and calls it "Real Unity Training." Its twelve core values include a desire for institutions to succeed, the belief that customer service should be a priority, respect for traditional "success principles" of hard work, integrity and accountability, and being financially responsible. They also include the perspective that, while our differences are to be acknowledged, what we have in common is greater. The appendices at the end of the book are lengthy and detailed, and form a valuable and fascinating historical reference. Appendix A contains the entire Supreme Court decisions of "Students for Fair Admission v. President and Fellows of Harvard College", and "Students for Fair Admission v. University of North Carolina." Included is the concurrence of Justice Thomas. Appendix B contains the legislation abolishing DEI at public colleges and universities as reflected is Texas and Florida law, and Appendix C is the 14th Amendment to the U.S. Constitution.

It was surprising to experience the intellectual robustness and thorough substantiation of the Supreme Court's decision. Justice Clarence Thomas, writing the concurrence, was devastating in his disagreement with the dissent. The legislation abolishing DEI at public colleges and universities in Texas and Florida affirms that equal protection violations are on the decline.

Never buy from BnN again, their customer serivce is the worst I have ever dealt with

Purchased three items on 12/8, one to be shipped and two to pick up. Got confirmation email saying I was charged for and purchased all three items. Went to pick up my items on 12/9, it took three in-store reps to figure out that BnN mysteriously canceled one of my items. That means they also removed my bogo 50% discount. Didn't bother to inform me. Since I needed all three items, they were a set, I asked to cancel my order altogether so that I may re-purchase them and have all three items shipped, and receive the discount. The in-store rep told me they couldn't cancel it, I had to ask customer service to cancel it. So I tried using their chat, rep was useless and can't modify or change the order in any way. Couldn't change the missing item to be shipped, couldn't cancel the order, refused to let me place a new order with the rep so the missing item could be shipped and I could receive the discount and shipping reduction, since I have already paid for shipping on my original order. Informed repeatedly that I needed to call the customer service line, they are the only ones who could cancel my order. I tried their email option, they never responded. I tried going back to the store, they said call customer service. So I called customer service and was on hold over 40mins. First rep is from India, can't be bothered to do anything about my order. Demanded a manager. The manager is just as useless, refuses to cancel it, refuses to change it to shipped, refused to let me place a new order, refuses to let me switch it to pickup at a different store that had it in stock. Had to ask for HER manager. Finally I get a really nice sounding lady, told her I just needed to cancel my order. Mind you all this has happened in less than 24/hrs after placing my order, which they canceled 33% of without my knowledge or consent. Finally she says yea, no problem, let me cancel that whole order for you, you will get an email confirming the cancellation. I thank her profusely, since this is all i ever wanted, they cancelled 33% of my order, they can cancel the other 66%. Two hours later, I still havent received confirmation that my order was cancelled and the website shows it as processing still. So there is a good chance they STILL havent canceled my order, even after getting to second stage management and being told repeatedly this is what I had to do to get my order canceled, an order that they sold me and refused to provide. Most likely I get to scream at them some more tomorrow. Seriously, just cancel my order, you sold me a book you don't have. If none of your reps can modify an order in any way imaginable, why are you paying them? I always loved shopping at BnN but never again after this.

Tip for consumers:

Don't. Order from another big retailer that has these same books, for cheaper, and will actually ship them to you

Job interview

Before I start, let me warn whoever wants to apply to any position in Stamford Barnes and Noble: DO NOT APPLY. There's a manager who will never hire you but will insult and humiliate you.

Last year, I applied for head cashier position and he interviewed me. He was sarcastic and rude. Towards the end of my interview, he told me that he wasn't the manager and as soon as manager comes in he/she'll review my application. It was rejected. I applied again couple of months later, for part time book seller, and it was him calling me again, saying that I was picked for interview and that him and I spoke before.

I went to the store and did interview for 20 minutes. The manager was AGAIN sarcastic and rude to me. He then called another manager for I guess it is called "Second interview" or something. After that, I got an email from Barnes and Noble human resource requesting for background check. I did background check online. The manager called me at 7:00 PM on Friday asking him to call back regarding my background check and he GAVE HIS CELL PHONE NUMBER. I did call back through his cell phone number, but he never called me back. I even left message for him through his co-worker. HE NEVER CONTACTED ME. I called him and finally spoke to him and he tells me that I have to reply back to the email that was sent by the human resource. However, that was weird because the email includes "Do not Reply". He tells me that unless I reply back there won't be any background check unless I reply back. I did ignore that advice because technically it made no sense. The background check did go through and I got the consumer report from the Barnes and Noble indicating that the background check is complete. I called the manager and he told me flatly, that he decided not to hire me. Since I wasn't hired anyway, I asked whether he called my references and he told me he didn't and my background check was fine, but just decided that he didn't want to hire me. I'm not quite sure why he decided to go through background check if he decided not to hire me from the beginning. Also why he called me at night and giving me his cell phone number. I'm not sure why he never responded back despite leaving messages after he tells me to call back. I feel that he was never going to hire me anyway and just call me up to play with me.

I never met anyone so cruel in my life and I don't want to go through what I went through again. Is this how Barnes and Noble company treats people? Or is it just him?
