ShopSmarter.com Shopping Portal Screws Members Out of Their 10% in Earned Commissions! Let's Take Legal Action

Has anyone used this shopping portal site before? Just like eBates, Mr. Rebate, etc. ShopSmater.com is a web portal site that has links to various retailers who pay them (ShopSmarter) a commission to direct their member shoppers to the retailer website that the shoppers would like to purchase from. But unlike those free to use portal sites, ShopSmarter.com will charge you about $10 a month to be a member, but promises to reward the member with a 10% cash back for all purchases--which is significantly much higher than that of what the other sites like ebates will pay out. However, since these guys at ShopSmarter have realized that paying out 10% in cashback to shoppers who shop online frequently, and/or those who make high priced purchases can be a rather expensive consequence... they have devised some clever "hidden" policies to try and avoid these payouts. First off, if they see that you're doing quite a bit of shopping, they will eventually lock your account and accuse you of shopping for "business purposes." They will then ask you to provide proof of the purchases that you made to show that they are indeed for personal use and not business use. But even if you comply and are able to prove that the items you bought were for personal use, they will try and find some other excuse to avoid big payouts. For instance, one individual pointed out that they made a major purchase of $2000 at Home Depot for an appliance, and ShopSmarter found a way to reject that transaction as something that doesn't qualify for the cashback. What was their reason? The appliance had to be picked up in store by the customer, and apparently ShopSmarter only pays cashback for items that are shipped to the member's residence. Is this even mentioned in their terms & conditions? Your guess is as good as mine... but they say that is their policy. Looking around the internet on sites like SiteJabber, it is clear that there are in fact various members they screw over. They collect the membership fee of $10 per month, and they also keep the commission that they get from the retailers that are earned from their members who use their portal site, but yet they continually look for excuses to avoid the payouts to these members. If that is not the definition of a scam site, then I don't know what is?

And that's why I would like to hit these scum-suckers with a massive class action lawsuit that hopefully puts them out of business and will also allow those of us who have been victimized, swindled, and taken advantage of by them, to finally get the 10% rewards that we are rightfully owed.
